TERMS AND CONDITIONS

Hence, the client acknowledges to have read and understood these Terms and Conditions and commits to respecting them. These Terms and Conditions are modifiable at any time, and the applicable terms and conditions shall be those in effect at the date when the booking is made.

TARIFFS

All tariffs are expressed in €uro and inclusive of tax at the rate of VAT applicable on the day of booking. Any change to the applicable rate, or any modification or introduction of new legal taxes by the competent authorities shall automatically be added to the prices shown on the date of invoice.

Unless otherwise specified, the tariffs shown are per night and per room. Breakfast and other services are invoiced per person and per day.

Any object left behind and requiring to be shipped at your request will be invoiced.

The tourist tax, an extra charge, shall be paid directly on site. The tariff applied shall be that in effect set by the Council of the towns where the relevant establishment is situated (unless otherwise specified in the booking).

BOOKINGS

Bookings may be made through the site https://aubergedelacalanque.fr/, by telephone, e-mail or letter. Any booking shall only become final on reception of a deposit equivalent to 30% of the total amount of the stay, debited by the hotel by means of a payment card valid up to the date of the end of the stay.

Payment for all services shall be made directly at the hotel (with the exception of bookings prepaid at the time of booking).

The hotel reserves the right to refuse any booking should the credit card number be incorrect or if the booking is incomplete. Regardless of the country of origin, all bookings are payable only in €uro.

FORCE MAJEURE

Force majeure is understood as any event outside the control of the parties concerned that is both unforeseeable and insurmountable and that prevents the client from undertaking the trip, and carrying out any, or any part of, their obligations under the contract. Excluded from this are events such as transport strikes, hotel staff strikes, government or public riots.

MODIFICATION AND CANCELLATION OF BOOKINGS

In the case of cancellation up until 30 days before the due arrival date, the hotel shall debit 20€ fixed costs per room.
Between 29 days and 8 days before the due arrival date, the hotel will not refund the deposit.
Between 7 days and 48 hours before the due arrival date, the hotel will debit 50% of the total amount of the stay.
Less than 48 hours before the due arrival date and in case of non-arrival, the hotel will debit the full amount of the booking.
In the case of a modification for reduced services or in the case of early departure, any stay initially booked shall be owed in full.
Any booking made through a third party provider (Booking.com, Opodo, Expédia etc.) is to be cancelled or modified directly with that provider.

THE HOTEL AND ITS SERVICES

The tariff for a child’s breakfast is applicable to children up to but not including 12 years old.
Pets are welcome in the hotel for an additional charge of 5€/day except in the area around the swimming pool. Bedrooms are available only from 4pm onwards and must be vacated by 11am on the day of departure. An additional charge may be invoiced should the deadline for departure not be met. The client accepts and commits to use the bedrooms as a responsible adult. Furthermore, any behaviour against moral decency or law and order shall lead to the hotel owner asking the client to leave the establishment without compensation nor refund should payment already have been made.

TRANSFER

Should the Auberge de la Calanque not be available or in case of force majeure, the hotel reserves the transfer the client, for the full or partial duration, to a hotel of an equivalent or higher category, proposing services of the same level. The transfer shall be at the expense of the hotel owner who may not be sued for any further compensation.

CLAIMS

ethicsPolicy Any claim must be addressed to the Auberge de la Calanque by registered letter with acknowledgement of receipt within 15 days following the departure from the stay subject to the said claim. After such date, no claim shall be taken into account.

USE OF THE WI-FI CONNECTION

L’Auberge de la Calanque proposes Wi-Fi internet access. The client user promises to ensure that the IT resources available to him/her will in no way be used for reproducing, representing, making available or communicating to the public, works or objects protected by copyright or similar right, such as texts, photographic images, musical and audio-visual works, software and video games, without the authorisation of the owners of the rights as set out in books I and II of the French Code on Intellectual Property when such authorisation is required.

LIABILITY

L’Auberge de la Calanque declines all liability in case of theft, loss or damage to items belonging to clients during their stay. The client shall be held liable for any damage, deterioration or any act of vandalism that may occur as a result of occupying the premises/or as a result of the participants and/or staff under his/her charge, whether to movable or immovable goods or decoration belonging or not to the hotel.

L’Auberge de la Calanque can therefore request the client to leave the establishment without any compensation and without any refund for the interrupted stay and ask him/her to pay for the damage caused by his/her acts.

GOVERNING LAW

These General Terms and Conditions are governed by French law. This is the case for substantive and procedural rules. Disputes fall within the exclusive competence of French jurisdictions.
